Circuit Court Clerk Mary Webb
The Office of the Clerk of the Circuit Court is a Constitutional Office. While the Clerk is elected on a county-wide basis to a four-year term, it is not a county office as defined by the Illinois Constitution. It is a non-judicial office of the Judicial Branch of State government. The duties are set forth by statute, Rules of the Supreme Court and Administrative Orders of the local Circuit Court. The Montgomery Circuit Clerk of the Court is an official of the 4th Judicial Circuit Court.
The clerk is required to attend all sessions of court, keep and preserve all records and files of the court, make, keep and preserve complete records of all the proceedings and determinations of the court, issue process as required by law, and is the Keeper of the Seal of the Court.
The Circuit Court, under the Illinois Constitution, is the trial level court. It handles every type of case from traffic tickets to a murder case, from Small Claims to a multi-million dollar personal injury suit, and from adoption to the probate of an estate.

Individuals who wish to view case files and documents on file with the Circuit Clerk may do so free of charge from 8:00 a.m. - 4:00 p.m., Monday through Friday. If copies need to be made, there is a statutory fee per page. By law, juvenile and adoption case files and any document sealed by the Circuit Court cannot be made available for public inspection.
The Circuit Clerk and the deputy clerks by law cannot give legal advice. Individuals who ask legal questions will be directed to consult with an attorney.
Petit Jurors, Grand Jurors, and Coroners Jurors are summoned for service by the Jury Commission and the Circuit Clerk. An answering machine provides information to prospective jurors the evening before service is required for the Petit and Grand Jurors.
Passport applications are provided and accepted for submission to the Passport Agency.
Child Support payments made in the Circuit Clerk's office are recorded and distributed as per the Court Order. Also, payments made to the State Disbursement Unit are recorded.
